Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and [NJONDA Holdings -- registered entity name to be confirmed] ("NJONDA", "we", "us") governing your use of the NJONDA mobile apps, web portals, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.

2. Description of Service

NJONDA is a multi-vendor marketplace and services platform. Through the Services you can, depending on your account type: browse and buy from independent vendors (marketplace, grocery, food, pharmacy, hotels); request ride-hailing, parcel delivery, and other on-demand services from independent drivers and service providers; book travel and event tickets; and chat with Shaheed AI, our in-app assistant. NJONDA is a platform connecting customers with independent vendors and service providers -- we are not the vendor, driver, or service provider ourselves except where explicitly stated.

3. Eligibility and Account Registration

• You must be at least 18 years old to create an account.
• You must provide accurate, current information and keep it up to date.
• You're responsible for keeping your password confidential and for all activity under your account.
• One account per person. Vendor and driver/provider accounts are subject to an additional approval and verification process before they can list products or accept jobs.

4. Customer Responsibilities

• Provide accurate delivery/pickup information -- we're not responsible for a failed delivery caused by an incorrect address you supplied.
• Pay the full amount due for any order or booking you place.
• Treat vendors, drivers, and service providers with respect; abusive behavior toward them is grounds for suspension.
• Only order prescription medicines you're legitimately authorized to purchase, using a genuine, current prescription.

5. Vendor Terms

• Vendors must be approved before listing products, and must keep their listings, prices, and stock accurate.
• Vendors are responsible for the quality, safety, and legality of what they sell, and for fulfilling orders promptly.
• NJONDA charges a commission on completed sales, deducted from the settled payment before funds are credited to the vendor's wallet, at the rate configured for the vendor's category at the time of sale. Vendors can view their applicable rate and full transaction history from their Payments page.
• NJONDA may suspend or remove a vendor for repeated order failures, policy violations, or fraudulent activity.

6. Driver and Service Provider Terms

• Drivers and service providers must be approved and, where applicable, hold any license or permit required by local law to perform the service offered.
• For ride-hailing and trade services, you set or negotiate your own price through the bidding/quote system -- NJONDA does not set your rates.
• You're responsible for your own vehicle, equipment, and compliance with local transport and safety regulations.
• NJONDA charges a commission on completed jobs, deducted before funds are credited to your wallet, at the rate applicable to your service category.

7. Orders, Pricing, and Payments

Prices shown at checkout include everything you'll be charged for that order except any fee the payment method itself may charge you (e.g. a mobile money provider's own transaction fee, if any). Payment is processed by PayChangu, PayPal, or, for manual methods, verified directly by our team -- see the Privacy Policy for how each is handled. An order is only confirmed once payment is verified as successful; if verification fails or is never received, the order does not proceed and you will not be charged (or will be refunded if a charge was already captured).

8. Cancellations and Refunds

Cancellation and refund eligibility depends on the order status at the time you cancel -- generally, an order can be cancelled before a vendor begins preparing it or a driver accepts it, and becomes harder to cancel the further along it is. Where a refund is due, it's processed back through the original payment method. Contact support through the app for any cancellation or refund request outside what you can do directly in the app.

9. Prescription Medication

Any product marked as requiring a prescription can only be purchased after a licensed pharmacist reviewing your account has approved a valid prescription you've uploaded. NJONDA facilitates this verification but does not itself practice medicine or pharmacy -- the pharmacy vendor fulfilling your order is responsible for the medicine dispensed. Never use the Services to obtain medication you don't have a legitimate, current prescription for.

10. Shaheed AI

Shaheed AI is an automated assistant, not a human employee, and its responses may occasionally be inaccurate or incomplete -- always verify anything important (prices, availability, medical or legal guidance) independently rather than relying on the assistant alone. Shaheed AI will only take an action that spends money or creates a booking on your behalf after you've explicitly confirmed it in a follow-up message; it will not do so speculatively or without your clear agreement.

11. Prohibited Conduct

• Using the Services for anything illegal, fraudulent, or that infringes someone else's rights.
• Attempting to bypass, disable, or interfere with any security feature of the Services.
• Scraping, reverse-engineering, or using automated means to access the Services beyond normal use.
• Impersonating another person or misrepresenting your affiliation with anyone.
• Harassing, threatening, or abusing another user, vendor, driver, or our staff.
• Attempting to manipulate reviews, ratings, or the AI assistant into acting outside these Terms.

12. Intellectual Property

The NJONDA name, logo, and app are our property or licensed to us, and this agreement doesn't grant you any right to use them beyond what's needed to use the Services normally. Content vendors post (product listings, photos, descriptions) remains their property, but by posting it they grant NJONDA a license to display it within the Services.

13. Disclaimers and Limitation of Liability

The Services are provided "as is." To the maximum extent permitted by law, NJONDA disclaims warranties of any kind, and is not liable for indirect, incidental, or consequential damages arising from your use of the Services, or for the acts or omissions of independent vendors, drivers, and service providers, who are not our employees. Nothing in these Terms limits liability that cannot be limited under applicable consumer protection law.

14. Indemnification

You agree to indemnify NJONDA against claims arising from your violation of these Terms or misuse of the Services, to the extent permitted by law.

15. Dispute Resolution

If a dispute arises, please contact support first -- most issues are resolved faster that way than through formal proceedings. Where a dispute can't be resolved directly, it will be handled under the governing law and venue described in Section 17, without prejudice to any right you have under mandatory consumer protection law to bring a claim in your own local courts.

16. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your account for violating these Terms, fraudulent activity, or extended inactivity, with notice where reasonably possible. Sections of these Terms that by their nature should survive termination (payment obligations already incurred, liability limitations) continue to apply.

17. Governing Law

These Terms are governed by the laws of the Republic of Malawi, without regard to conflict-of-law principles, except where mandatory local consumer protection law in your own country requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time; we'll update the effective date above and, for material changes, notify you in-app before they take effect. Continuing to use the Services after a change takes effect means you accept the updated Terms.
